For new diversion hi-way: CSur to expropriate lands in four towns

The provincial government of Camarines Sur will soon embark in massive construction works for a new diversion road passing through four towns aimed to solve mounting traffic congestion in the province.

Bicol Mail learned this following summons by publication published in this paper that started last week. The summonses were addressed to several defendants who were not served by the writs as per sheriff’s return dated Mar. 6, 2019 in Special Civil Case (SCC) No. 2018-0158 for expropriation, entitled Province Of Camarines Sur represented by Governor Miguel Luis R. Villafuerte versus several defendants, now pending before Branch 61, of the Regional Trial Court (RTC) of Naga City.

In a complaint filed by the provincial government of Camarines Sur through its provincial legal officer, Janis Ian B. Regaspi-Cleofe in SCC No. 2018-0158, it cited as defendants the following: Perfecto Bragais; heirs of Ana SJ Badiola; Winnie Enrile; Catherine Enrile; heirs of Lazaro Aguila; heirs of Sixto Beltran; heirs of Rodulfo Dato Jr.; Soledad Hidalgo; heirs of Aquilino Guinhawa; Horacio B. Llamas ; Enrico Tosoc; heirs of Salud De Asis; heirs of David Naz;

Heirs of Ramon Balid; Expectation De Guzman; Cepriano Cezar; Antonio Fabay; Juan Cezar; Estelito Alegre; Roberto Saniedo; Rufo Cezar; Felicismo Cezar; Benigna Barrameda; Nonito Barrameda; heirs of Fernando Valenzuela ; heirs of Melchor Valenzuela;

Jaime Arce; heirs of Silvestre Alvarez; Benito Gonzales Jr., Nemesio Gonzales;

Rogelio Follero; Alicia Torrero; Armando Hugo; heirs of Domingo Corporal; Danilo Larcena; heirs of Rosario Namoro; heirs of Melton Hugo; Arsenio Hugo; Fedela Sadang; Melecio Encinas, Celestino Caceres; Carmelita De Asis-Tanay; Adelaida Hernandez; Bonifacio Flores; and Roberto Beriña.

The complaint alleged that the lots targeted for expropriation are intended to be used for the construction of a diversion highway including its complementary facilities that aim to solve traffic congestion in the province as well as to hasten the province’s economic development and advancement.

Governor Villafuerte was duly authorized to institute the expropriation case by virtue of Provincial Ordinance No. 048, Series of 2015 and Provincial Ordinance No.008, Series of 2017.

The governor declared under oath that the lots subjected for expropriation proceedings are located in different barangays, namely: Manapao; Taban; Irayang Solong; Bagongbong; San Juan-San Lorenzo; San Felipe-Santiago; Del Carmen; Mataoroc; and Catanusan in Minalabac, Camarines Sur; Balagbag in Milaor. Buenavista in San Fernando, and Anayan, Binobong, New San Roque and Tagbong of Pili, all in Camarines Sur province.

As of press time, none of the defendants cited in the complaint filed any pleading in court.
