EDITORIAL: Justice Delayed

THE decision on whether the Philippines will re-join the International Criminal Court (ICC) and aid its investigation into former President Rodrigo Duterte’s drug war has reignited a contentious debate.


At the heart of this issue lies a broader question: What is the nation’s commitment to justice and human rights in the face of damning revelations from recent House hearings?


The Department of Justice (DOJ) has acknowledged calls to submit congressional reports on drug war killings to the ICC. Yet, the final decision rests solely with President Ferdinand Marcos Jr., as emphasized by Assistant Justice Secretary Mico Clavano.


Malacañang, for its part, has been unequivocal: the Philippines will not return to the ICC. Executive Secretary Lucas Bersamin’s statement reflects the administration’s refusal to alter its stance, despite the growing chorus of voices urging cooperation with the international court.


What complicates this issue further are the alarming testimonies coming to light, implicating high-profile figures in Duterte’s administration. The most recent revelations from retired Police Col. Royina Garma, former mayor Jed Mabilog, and Kerwin Espinosa expose a chilling pattern of extrajudicial killings and political coercion.


These accounts give weight to the ICC’s interest in investigating the Duterte administration for crimes against humanity. However, for now, Solicitor General Menardo Guevarra suggests that the evidence be directed to local authorities, such as the DOJ, National Bureau of Investigation, or Ombudsman.


The political dynamics between the Marcoses and Dutertes add another layer to this already complex matter. While Justice Secretary Jesus Crispin Remulla has indicated that the country would not block Interpol’s involvement if the ICC issues warrants, the administration’s reluctance to fully cooperate raises questions about transparency and accountability.


President Marcos faces a defining moment. While he is the chief architect of the country’s foreign policy, his decision on the ICC must transcend politics and rivalries. The testimonies emerging from the House hearings and the mounting evidence of state-sponsored violence demand nothing less than a serious, impartial investigation—whether through the ICC or local mechanisms.


Re-joining the ICC would send a powerful message that the Philippines is committed to upholding human rights and ensuring justice for victims. Refusing to engage with the ICC risks signalling to the world that the country is willing to turn a blind eye to its darkest chapters.


The calls for justice will not be silenced. If the Philippines is to honor its democratic ideals, the Marcos administration must take the courageous step of reconsidering its stance. It is time to face the truth, however uncomfortable it may be, and to allow the ICC its due course.
